1. Information on how to enter and prizes form part of these Terms and Conditions. Entry and/or participation in this competition is deemed acceptance of these Terms and Conditions. Acceptance of these Terms and Conditions is a condition of entry to this competition.
  2. Entry to this competition will open on Monday 15/03/2021 at 12.01am AEDT and close at 11.59pm AEST on Saturday 31/07/2021 (“Entry Period”).
  3. Entry is open to Australian residents aged 18 years or older who can take the prizes (if selected as a winner in accordance with the conditions set out in clause 13) and who have purchased and used a product made from COLORBOND® steel on:


    1. a residential property they own (including their home, farms and investment properties); or
    2. business premises that they own; or
    3. a project they worked on in their role with a business. This could include but is not limited to colour and design consultants and specifiers that supply, specify or install COLORBOND® steel products in Australia, subject to the conditions set out in clause 4 below.


  4. If an Entrant is entering a project that was completed as part of their role with a business, they must:


    1. have consent from that business to enter this competition and for the name of the business to be featured in accordance with clause 7, and, where required by that businesses’ policies or rules, for the Entrant to accept the prize if they are selected as a winner;
    2. have permission from all relevant stakeholders in the project before they submit the project (including from the project client and the building owner) to provide the information relating to the project, including the address of the project, COLORBOND® steel products used in the project and an image of the building (which will be published and publicly viewable, together with the local suburb area where the building is located), as part of this promotion, and for the use of the content submitted in accordance with clauses 7, 16 and 17.


  5. Employees of the Promoter, businesses owned by the Promoter and agencies or organisations associated with this competition (and those employees' immediate families) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. To enter, Entrants must, during the Entry Period, visit colorbond.com/lovedalloveraustralia (“Competition Website”) and follow the prompts on the Competition Website to submit an entry, including by completing the following steps:


    • Select one of the following options, to indicate what type of property or project their entry relates to:


      • Residential property I own;
      • Business premise I own; or
      • Project I worked on as part of my role with a business;


    • Input their requested personal details;
    • Input the address of the home, business premises or project (as applicable) (“Premises”) that features COLORBOND® steel products, what COLORBOND® steel products were used and in what application(s);
    • Upload one photograph of the Premises that show the COLORBOND® steel used on the Premises and provide a caption for that photograph, in 25 words or less, about why they love how COLORBOND® steel is used on the Premises;
    • Submit the fully completed entry form.


  7. The Promoter will feature a virtual map of Australia on the Competition Website, which may also be published on other website(s) owned or licensed by the Promoter, on the Promoter’s social media platforms and in other media at the Promoter’s discretion, and will pin the location of each entry’s Premises on the map (on street level). Each pin will publicly show the first name of the Entrant (and, if they submitted their entry for a project they did as part of their role with a business, the name of that business), what applications COLORBOND® steel products were used in on the Premises, location of the Premises (on suburb level area – no street names or numbers will be published), the photograph of the Premises and the caption submitted for the photograph. The Promoter may, in its discretion, edit the submitted photograph (to improve the resolution or similar) and/or caption provided for the photograph (but not in a way that would change the context/meaning of the answer). The Promoter may also refuse to publish any entry in its discretion, including but not limited to, if it determined that the entry is ineligible. All entries are subject to the conditions and licenses set out in clauses 16 and 17. Publication of an entry is not an indication that an entry has been selected as a winning entry.
  8. Incomplete or indecipherable entries will be deemed invalid.
  9. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including their identity, age and place of employment) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  10. The following limits on entry is applicable:


    • An Entrant can submit multiple entries providing that each entry they submit is for different Premises.
    • Multiple Entrants can submit an entry for the same Premises (e.g. if more than one person worked on the design for particular Premises, each individual can submit a separate entry and so can the owner of the Premises);
    • Each entry must be submitted separately and in accordance with entry requirements.


  11. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
  12. The judging will take place at Tower A, Level 7, 201 Coward Street, Mascot NSW 2061. At the end of each calendar month of the Entry Period a judging round will be conducted (each a “Monthly Judging Round”) where a total of ten winners will be selected for a Monthly Prize (out of the entries received between 00.01 on the first day and 23.59 on the last day of each month). Each Monthly Prize winner will be selected by the 15th of the following month after entries close, based on the criteria in clause 13. At the end of the Entry Period, an additional judging round will be conducted (“Grand Prize Judging Round”) where all the Monthly Prize winners will be judged against each other based on the criteria in clause 13, and one (1) will be selected as the winner of the Grand Prize. The judges may select additional reserve entries in each judging round which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible Entrant. Winners will be notified by email and/or by SMS text message or telephone and will have their names published on colorbond.com/lovedalloveraustralia. The Grand Prize Judging Round winner will be announced by 20/08/2021 and published on colorbond.com/lovedalloveraustralia
  13. This is a game of skill and chance plays no part in determining the winners. Each entry in each judging round will be individually judged based on the creativity of the photo caption submitted by the Entrant, how well that caption compliments the submitted photograph and how products made from COLORBOND® steel are showcased in their submitted Premises (as shown in the submitted photograph). The ten (10) valid entries judged to be the best in each Monthly Judging Round, as determined by the judges in their absolute discretion, will receive a prize of a $100 Virtual Prepaid Mastercard (“Monthly Prize”). The Monthly Prize will be sent by email to each winner to the email address provided in the entry form. The Monthly Prize winner judged to be the best out of all Monthly Prize winners in the Grand Prize Judging Round will receive the “Grand Prize” consisting of:


    • a Harwyn Home Office Pod, model Professional-ii as listed at https://harwyn.com.au/pro/ valued at $45,679 (+GST). The options and inclusions of the Home office Pod will be pre-selected by the Promoter in its discretion, however, the winner will be able to select their preferred colour for the external walling from the five COLORBOND® steel Matt options: COLORBOND® steel Matt in the colour Surfmist®, COLORBOND® steel Matt in the colour Shale Grey, COLORBOND® steel Matt in the colour Dune®, COLORBOND® steel Matt in the colour Basalt® and COLORBOND® steel Matt in the colour Monument®; and
    • Delivery and installation of the Harwyn Home Office Pod at a site in Australia of the Grand Prize winner’s choosing, to the maximum value of up to $20,000. If the delivery and/or installation to the site or location requested by the Grand Prize winner exceeds $20,000 then any balance over $20,000 will need to be paid for by the Grand Prize winner (or the winner can elect to organize their own delivery and installation). If the cost of delivery and installation is less than $20,000, the remaining allocated value will be forfeited and is not payable to the winner. Delivery and installation costs will be paid directly to the relevant supplier and not to the winner. The Harwyn Home Office Pod, model Professional-ii is 2.7 (w) x 3.6 (l) and requires at least a 1-meter offset from any property boundary and 30cm clearance on any other side. Installation also requires clear airspace above the pod (no eaves, tree or other obstructions) so it can be craned into position. It is the Entrant’s responsibility to seek and obtain any necessary permits from the local council/local government and obtain all necessary consents from all owners of their chosen location for the installation of the Home Office Pod if the Entrant is selected as the Grand Prize winner. The Grand Prize winner must provide to the Promoter proof of consent to install and any council permissions prior to installation at their chosen location.


  14. The prizes are not transferable, exchangeable or redeemable for cash, unless otherwise agreed by the Promoter in its sole discretion. Any ancillary costs associated with redeeming the Virtual Prepaid Mastercard are not included. Any unused balance of the Virtual Prepaid Mastercard will not be awarded as cash. Redemption of the Virtual Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Virtual Prepaid Mastercard. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited, unless otherwise specified by the Promoter. If any prize is unavailable, the Promoter, in its discretion but subject to law, reserves the right to substitute the prize with a prize to the equal value and/or specification.
  15. The Promoter's and judges' decision is final and binding, and no correspondence will be entered into. The prize in each instance will be awarded to Entrant who submitted the entry.
  16. By entering this competition, each entrant warrants and agrees that: (a) they are fully responsible for any materials they submit via the competition including but not limited to photographs, the caption for their photograph, the address for the Premises, comments, and images (“Content”); (b) the Content may be made available for public viewing on the Competition Website, the Promoter’s social media platforms and other websites and media; (c) any persons depicted in the photograph uploaded must be decently dressed and presented and the Content, must not be unlawful or fraudulent, or in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (d) all Content is subject to the approval of the Promoter. The Promoter reserves the right to vet all entries at any time in its absolute discretion. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. However, the Promoter is not responsible for any Content uploaded to the Competition Website and visitors to the site view it at their own risk and the Promoter is not responsible for such Content to the full extent permitted by law; (e) entrants must own the copyright in the Content uploaded or be entitled and have permission to use the Content in the manner contemplated by these Terms and Conditions, including use of the Content for promotional purposes in accordance with these Terms and Conditions; (f) the entrant has the permission of every person featured in the photograph, or, if any person is under the age of 18, the permission of their parent or legal guardian, to enter the photograph in accordance with these Terms and Conditions, including consent to each condition in this clause; (g) the entrant has notified each person featured in the photograph, or, if any person is under the age of 18, that person's parent or legal guardian, of the Promoter's privacy policy (available at https://cdn.dcs.bluescope.com.au/download/bluescope-privacy-policy) and each person or parent or legal guardian (as the case may be) has agreed to that privacy policy; (h) their Content shall not contain viruses or cause injury or harm to any person or entity; (i) they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content, and their employer if entering a Premises that are a project they worked on as part of their work; (j) they consent to any use of the Content which may otherwise infringe the Content creator's/creators' moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and (k) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  17. Entrants warrant that their entry is original and does not infringe the intellectual property rights of any third party. Each Entrant licences and grants the Promoter, its affiliates and sub-licensees a non-exclusive, transferable, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to for the purposes of the Promoter's business, for future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement. To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.
  18. All taxes which may be payable as a consequence of receiving either the Monthly Prize or Grand Prize are the sole responsibility of the winner. BlueScope reserves the right to approve of a transfer of the Grand Prize if requested by the winner for charitable purposes.
  19. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the competition.
  20. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
  21. The winners should allow up to 14 working days for the Promoter to arrange the delivery of the Monthly Prizes. The period for delivery and installation of the Grand Prize will be determined based on the Grand Prize winner’s location and notified to the winner once they select their location.. If the Promoter is unable to contact any of the Monthly Winners or Grand Prize Winner within two weeks of the Judging Date for that period, that winner will forfeit the Prize and the Prize shall be awarded to the next best entry (as determined by the judges). The Promoter will not be liable for a winner who does not respond to the Promoter's direct private email message or phone call.
  22. If for any reason a winner does not take/claim a Prize at or by the time stipulated by the Promoter, then the Prize will be forfeited.
  23. Entrants consent to the Promoter using their name, likeness, image, photograph and/or voice in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
  24. The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://cdn.dcs.bluescope.com.au/download/bluescope-privacy-policy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to entities outside of Australia – see the Privacy Policy for details. The address for the premises (street level), the photograph submitted, and the first name of the entrant will also be published as outlined in clause 7.
  25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of/taking of the Prize.
  27. As a condition of accepting the Monthly Prize and/or Grand Prize, each winner may be required to sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
