“The Block” Internal Promotion 2022

TERMS AND CONDITIONS

  1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. The promoter is BlueScope Steel Limited (ABN 16 000 011 058) of Level 11, 120 Collins Street, Melbourne, VIC 3000 telephone 03 9666 4000 ("Promoter").
  3. Entry is only open to Australian residents who are an employee of the Promoter, on a permanent, part time or casual basis. Employees of the Promoter who are directly involved in the conduct of this promotion, including winner selection, will not be eligible to enter. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  4. This promotion starts 03/08/22 and ends 11.59pm AEST the day before "The Block Auction" airs on Channel 9 ("Promotional Period"). The date "The Block Auction" airs will be provided on "The Block 2022" Workplace page when confirmed.
  5. To enter, eligible entrants must join "The Block 2022" group on Workplace during the Promotional Period.
  6. Only one (1) entry is permitted per person.
  7. The first fifty (50) entries will go into a secondary draw to win a secondary prize.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and employment) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process including but not limited to tampering with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. Incomplete or indecipherable entries will be deemed invalid.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. There will be two (2) draws conducted for this promotion consisting of a draw for the Major Prize (defined below) and a draw for the Secondary Prize (defined below). All draws will take place at Anisimoff Legal, Suite 5, 210 Central Coast Highway, Erina, NSW, 2065. The draw for the Secondary Prize will take place at 10:00am AEST on 20/09/22. The draw for the Major Prize will take place at 10am AEDT on 10/11/22. The Promoter may draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn. The winners will be notified by email and phone within two (2) business days of the draw. Winners of the secondary prize draw will be published on "The Block 2022" Workplace group from 27/09/22 and the winner of the Major Prize will also be published on "The Block 2022" Workplace group from 16/11/22.
  12. The Promoter's decision is final and no correspondence will be entered into.
  13. The first valid entry drawn ("Major Prize Winner") will win a 'Tiny Escape' package valued at up to $3,000 ("Major Prize") consisting of the following:
    1. Shacky Voucher valued at $600 to spend on a stay at the Forest-Grampians, covering at least two (2) nights' accommodation. Voucher must be used within 1,000 days from the date of issue. Voucher is subject to the standard terms and conditions of the issuer as listed at  https://shacky.com/gift-cards/
    2. Flight Centre eGift Card valued at $2,400 that can be used on flights and car hire. eGift Card must be used within three (3) years from the date of issue.   14. Any ancillary costs associated with redeeming a gift voucher is not included. Any unused balance of any gift voucher will not be awarded as cash. Redemption of a gift voucher is subject to any terms and conditions of the issuer including those specified on the voucher itself.
  15. The Major Prize is subject to booking and flight availability. The Major Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize Winner may be required to present their credit card at time of accommodation check in. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
  16. A secondary prize winner will be drawn from the first fifty (50) entrants of the Promotion. The first entry drawn from the secondary prize draw ("Secondary Prize Winner"), will win a 'VIP tour of The Block' experience valued at up to $1,700 ("Secondary Prize") consisting of the following:
    1. A VIP tour of The Block 2022 location for the Secondary Prize Winner and one (1) companion, in November 2022 (date to be confirmed and notified to the winner once available);
    2. If the Secondary Prize Winner does not reside in VIC, two (2) return economy flights to Melbourne, VIC from the Secondary Prize Winner's nearest capital city. If the Secondary Prize Winner is from VIC, the prize will not include the flights and this element of the prize will be forfeited and will not be awarded as cash. If flights are not purchased for (2) individuals this element will be forfeited and will not be awarded as cash;
    3. Return transfers for two (2) people from the airport to the accommodation in Melbourne, or if the Secondary Prize Winner resides in VIC, return transfers from the Secondary Prize Winner's place of residence to accommodation in Melbourne, VIC. Exact mode of transfers will be determined by the Promoter;
    4. One (1) night twin share accommodation at a minimum four-star hotel for two (2) people in Melbourne (hotel selected by the Promoter); and
    5. Return transfers from the accommodation to The Block 2022 location. Mode of transportation will be determined by the Promoter.
      The Secondary Prize is subject to The Block renovation schedule, booking and flight availability. Spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point in case of flights, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in the prize. The Secondary Prize Winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Secondary Prize. The Secondary Prize is subject to the standard terms and conditions of individual prize and service providers. The Secondary Prize Winner may be required to present their credit card at time of accommodation check in. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.
      If the VIP tour cannot take place for any reason or if the Secondary Prize Winner cannot take the VIP tour (including due to any government restrictions or guidance), the VIP tour will be cancelled, and the Secondary Prize Winner will receive an Only1 Visa Gift Card valued at $1, 700 [Gift Card expires 11/2026.   17. As a condition of accepting the Secondary Prize, the Secondary Prize Winner agrees and must procure their travelling companion to agree:
    1. For the Promoter's representatives to take photographs and video of them during the prize, including during The Block tour ("Photos/Videos"), and that all intellectual property rights (including copyright) in such Photos/Videos vest in and remain with the Promoter;
    2. To participate in reasonable promotional activities, including photography/video sessions, interviews and appearances organised by the Promoter;
    3. To the Promoter using their name, likeness, image and/or voice (including as depicted in Photos/Videos, other photographs, film and/or recordings) and a story about the Secondary Prize Winner and their companion, in internal channels, for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and the Promoter and its products; and
    4. The Promoter has all editorial control over material featuring the Secondary Prize Winner and/or their companion, and any such material will not be subject to the Secondary Prize Winner's or their companion's prior approval.
  18. If the Major Prize Winner or Secondary Prize Winner is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf..
  19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take or redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  21. Total prize pool value is up to $4,700 (Major Prize $3,000, Secondary Prize $1,700).
  22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified by the Promoter.
  23. A draw for any unclaimed Major Prize may take place on 25/11/22 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner(s), if any, will be notified by email and telephone within two (2) business days of the draw and their names will be published on "The Block 2022" Workplace group.
  24. If the Secondary Prize is unclaimed, the prize will be forfeited.
  25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion at any time (including after the Promotional Period), as appropriate.
  26. Any cost associated with submitting an entry is the entrant's responsibility and is dependent on the Internet service provider used. .
  27. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.
  28. 27.28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if The Block event tour is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking a prize.
  30. As a condition of accepting the Major Prize or Secondary Prize, the Major Prize Winner and Secondary Prize Winner and their companions may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. If a winner or their companion is under the age of 18 years, their parent/legal guardian must execute any such documents on the minor's behalf.
  31. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://s3-ap-southeast-2.amazonaws.com/bluescope-corporate-umbraco-media/media/1040/privacy-policy.pdf The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter's Privacy Policy).
