1. Information on how to vote and prizes form part of these Terms and Conditions. Voting and/or participation in this competition is deemed acceptance of these Terms and Conditions. Acceptance of these Terms and Conditions is a condition of entry to this competition.
  2. Voting in this competition will open on Tuesday 30/11/2021 at 12.01am AEDT and close at 11.59pm AEDT on Monday 31/01/2022 (“Voting Period”).
  3. Voting is open to Australian residents aged 18 years or older.
  4. Employees of the Promoter or related bodies corporate of the Promoter and agencies or organisations associated with this competition (and those employees' immediate families) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. At the start of the Voter Period, the Promoter will make available, for voting purposes, on colorbond.com/lovedalloveraustralia/peopleschoice (“Competition Website”) a number of entries from the “COLORBOND® steel Loved all over Australia” promotion conducted by the Promoter between 30/11/2021 and 31/01/2022 (“People’s Choice Candidates”). The People’s Choice Candidates will be selected by the Promoter in its absolute discretion and will be required to agree to these Terms and Conditions when they agree to participate in this promotion. To vote, eligible individuals must, during the Voting Period, visit the Competition Website and select the “Vote” button next to the People’s Choice Candidate(s) that they would like to submit a vote for, during the Voting Period.
  6. Maximum one (1) vote per person and IP address for each People’s Choice Candidate. For the sake of clarity, voters may vote for more than one (1) People’s Choice Candidate, but a voter may only vote for each People’s Choice Candidate once.
  7. If there is a dispute as to the identity of a voter, the Promoter reserves the right, in its sole discretion, to determine the identity of the voter.
  8. The Promoter reserves the right, at any time, to verify the validity of votes and voters (including a voter's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the voting process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.
  10. This is a game of skill and chance plays no part in determining the winner.
  11. Subject to clause 12, the People’s Choice Candidate that receives the highest number of valid votes during the Voting Period will win a three-night stay at the Soul of Gerringong, boutique accommodation located in Gerringong, NSW. The package is valued at up to $13,000, which includes return economy airfares for two people from their nearest capital city to NSW (if necessary), selected transfers for two people and accommodation. If the winner is from NSW, the Prize does not include flights and this element of the prize will be forfeited and not redeemable for cash. Spending money, in room services, additional transfers ,insurance, meals and drinks and any other ancillary costs associated with redemption of the prize are not included and are the responsibility of the winner. Prize must be taken mid-week by 15/02/2023 and is subject to blackout dates, booking availability and any government restrictions present on travel at the time of redemption.
  12. If more than one People’s Choice Candidate receives the same highest number of votes, the Promoter will judge each of those People’s Choice Candidates based on the creativity of their entry and how well the entry showcases use of COLORBOND® steel products. The entry deemed to be the best by the Promoter, in its absolute discretion, will be deemed the winner and win the prize.
  13. Total prize pool value is up to $13,000, depending on the winner’s place of residence. For the avoidance of doubt, no prize is available for voters in this promotion.
  14. The winner will be notified by email and/or by SMS text message or telephone and will have their name published on colorbond.com/lovedalloveraustralia/peopleschoice. The winner will be announced by 15/02/2022 and published on colorbond.com.
  15. The prize is not transferable, exchangeable or redeemable for cash, unless otherwise agreed by the Promoter in its sole discretion. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited, unless otherwise specified by the Promoter.
  16. By agreeing to become a People’s Choice Candidate, each entrant warrants and agrees that it complies with the Terms and Conditions for the COLORBOND® steel Loved All Over Australia promotion and for their entry to be made subject to a public vote via the Competition Website.
  17. All taxes which may be payable as a consequence of receiving the Prize are the sole responsibility of the winner.
  18. The Promoter assumes no responsibility for any failure to receive an entry or vote for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the competition.
  19. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any People’s Choice Candidate, vote or voter; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
  20. If the Promoter is unable to contact the winner within two weeks, that winner will forfeit the prize and the prize shall be awarded to the entry that received the next highest count of votes (or the next best entry determined based on the tie breaker mechanism). The Promoter will not be liable for a winner who does not respond to the Promoter's direct private email message or phone call.
  21. If for any reason a winner does not take/claim the prize at or by the time stipulated by the Promoter, then the prize will be forfeited.
  22. Entrants consent to the Promoter using their name, likeness, image, photograph and/or voice in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
  23. The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry and voting is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://cdn.dcs.bluescope.com.au/download/bluescope-privacy-policy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the participants in the promotion. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to entities outside of Australia – see the Privacy Policy for details.
  24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of/taking of the prize.
  26. As a condition of accepting the prize, the winner may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
